EVENT TICKET TERMS & CONDITIONS - Governed by the laws of Kenya

By purchasing a ticket to, or attending, KODA OUTDOOR (the "Event"), you unconditionally agree to be bound by these Terms and Conditions in their entirety. These Terms constitute a legally binding agreement between you and KODA Nairobi ("the Organiser"). If you do not agree, you must not purchase a ticket or attend the Event.

  1. TICKET PURCHASE & AUTHENTICITY

1.1 Authorised Channels Tickets are sold exclusively through KODA Nairobi's official website, verified social media links, and authorised ticketing partners as announced on our official accounts. We accept no responsibility for tickets purchased through any other source.

1.2 Counterfeit & Fraudulent Tickets Purchasing tickets from unofficial third parties, resellers, street vendors, or unauthorised individuals is entirely at your own risk. The following applies:

— Any ticket that cannot be verified as authentic upon scanning will be refused entry. No refund or replacement will be provided. — KODA Nairobi bears no responsibility for counterfeit, duplicated, altered, or stolen tickets purchased outside official channels. — Where a duplicate ticket exists, the first valid scan takes precedence. Subsequent uses of the same ticket will be refused without recourse. — Persons found selling counterfeit tickets at or near the venue may be detained and handed to law enforcement. — KODA Nairobi is not liable for any financial loss suffered by any person who purchases a ticket from an unauthorised source.

1.3 Ticket Validity & Identification — Each ticket is a revocable personal licence to attend the Event. — The name on the ticket must match a valid government-issued photo ID (national ID, passport, or driving licence). Digital copies are permitted at the discretion of the gate team. — Tickets are strictly non-transferable. — Lost, stolen, damaged, or altered tickets or wristbands are invalid and will not be replaced or refunded. — Wristbands are non-transferable. Tampering with or sharing wristbands will result in immediate ejection without refund.

1.4 Refunds & Cancellations — All ticket sales are final. No refunds will be issued for change of plans, illness, or failure to attend. — If KODA Nairobi cancels the Event entirely, refunds will be issued at face value through the original point of purchase. Booking fees and travel costs are non-refundable. — If the Event is postponed, your ticket remains valid for the rescheduled date. If you cannot attend the new date, apply for a refund within 14 days of the postponement announcement by emailing contact@kodanairobi.com. — Refunds will be processed within 30 business days to the original payment method only.

2. ADMISSION & CONDUCT

2.1 Right of Admission KODA Nairobi reserves the absolute right to refuse entry or eject any person without refund where their conduct is unsafe, threatening, or in breach of these Terms, or where the venue has reached maximum capacity.

2.2 Zero-Tolerance Policy The Event operates a strict zero-tolerance policy toward harassment, sexual harassment, discrimination, intimidation, abuse, assault, or threatening behaviour directed at any attendee, staff member, performer, or contractor. Any breach may result in immediate ejection without refund and referral to law enforcement.

2.3 Age Restriction This is a strictly 21+ event. Valid government-issued photo ID must be presented upon request. KODA Nairobi accepts no liability where a minor gains entry by misrepresenting their age or using false identification.

2.4 Searches As a condition of entry, all Ticket Holders consent to reasonable search of their person and belongings by authorised security personnel. Refusal to be searched will result in denial of entry without refund.

3. PROHIBITED ITEMS & ACTIVITIES

The following are strictly prohibited. Items may be confiscated without compensation:

— Illegal drugs, controlled substances, or drug paraphernalia — Firearms, bladed weapons, or any item that could be used as a weapon — Outside food or beverages (unless authorised for medical or dietary reasons by prior arrangement) — Professional cameras or recording equipment without prior written media accreditation — Flares, fireworks, laser pens, or pyrotechnics — Drones or unmanned aerial vehicles without prior written consent — Any item deemed unsafe or inappropriate by Event management

Persons found in possession of illegal items may be detained and handed to law enforcement.

4. MEDIA, PHOTOGRAPHY & IMAGE RIGHTS

4.1 Event Recording The Event will be photographed, filmed, and recorded by KODA Nairobi and authorised media partners. By attending, you irrevocably consent to the capture and use of your image, voice, and likeness for promotional, editorial, marketing, and commercial purposes by KODA Nairobi, including on social media, websites, print, broadcast media, and future campaigns. All recordings remain the property of KODA Nairobi.

4.2 Image Removal Requests If you appear in published content and wish to request removal, email contact@kodanairobi.com with the subject line IMAGE REMOVAL REQUEST, including a description or link to the specific content. We will acknowledge within 5 business days and act in good faith to assess all requests. Removal may not be possible where content has been shared by third parties outside our control.

4.3 Attendee Photography Attendees may photograph or record for personal, non-commercial use via personal mobile devices only. You must not photograph or record any person who has expressly objected. Commercial or press use requires prior written media accreditation from KODA Nairobi.

5. DATA PROTECTION

Personal data collected in connection with ticketing and attendance is processed in accordance with the Data Protection Act, 2019 (Kenya), for the purposes of event management, security, fraud prevention, and promotion. We will not sell your personal data. You may request access, correction, or deletion of your data by emailing contact@kodanairobi.com.

6. LIABILITY & RISK

Attendance is at your own risk. To the fullest extent permitted by Kenyan law, KODA Nairobi shall not be liable for personal injury (unless caused by our proven negligence), loss or theft of personal property, or any indirect or consequential loss arising from attendance. KODA Nairobi is not liable for the actions of third parties including other attendees, contractors, or performers.

7. EVENT CHANGES & FORCE MAJEURE

KODA Nairobi reserves the right to modify, postpone, or cancel the Event due to circumstances within or beyond its control, including acts of God, weather, government restrictions, public health emergencies, civil unrest, venue failure, or performer cancellation without fault on our part. Artist substitutions may occur without notice. Ticket Holders are not entitled to a refund solely due to a support act substitution.​

8. ONLINE CONDUCT & SOCIAL MEDIA

We ask that all content shared about the Event is honest and respectful. You must not publish false, misleading, or defamatory statements about KODA Nairobi, its staff, contractors, or performers. If you have a genuine complaint, please contact us directly at contact@kodanairobi.com before publishing publicly. All written complaints will be acknowledged within 5 business days.

9. HEALTH & SAFETY

Ticket Holders must follow all reasonable instructions from Event staff and security at all times. The Organiser reserves the right to halt or terminate the Event in the interests of safety. You are responsible for taking appropriate precautions for outdoor weather conditions. Re-entry after exit is not guaranteed.

10. GOVERNING LAW

These Terms are governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
